ถนนพิพาทเป็นทางออกสู่ถนนสาธารณะ เริ่มสร้างเป็นเวลากว่า 10 ปีแล้ว ไม่มีผู้ใดห้ามปราม ถือได้ว่าเจ้าของที่ดินพิพาทเดิมได้ยกที่ดินส่วนที่ถนนพิพาทตัดผ่านให้เป็นทางสาธารณะ อันเป็นการสละที่ดินให้เป็นสาธารณสมบัติของแผ่นดินสำหรับพลเมืองใช้ร่วมกัน โดยไม่จำต้องมีการจดทะเบียนยกให้เป็นทางสาธารณะต่อพนักงานเจ้าหน้าที่
คำพิพากษาศาลฎีกาที่ 2526/2540
ศาลชั้นต้นกำหนดประเด็นข้อพิพาทว่าทางพิพาทเป็นทางภารจำยอมหรือไม่ แล้ววินิจฉัยว่าทางพิพาทไม่ได้เป็นทางภารจำยอม ห้ามจำเลยและบริวารใช้ทางพิพาท แต่เมื่อทางสาธารณะนั้นประชาชนทุกคนมีสิทธิใช้ได้ บุคคลใดก็ไม่มีอำนาจห้ามบุคคลอื่นใช้ทางสาธารณะ ดังนั้นแม้จำเลยจะสละข้อต่อสู้ที่ว่าถนนพิพาทเป็นทางสาธารณะไปแล้ว คงต่อสู้ว่าถนนพิพาทเป็นทางภารจำยอมเพียงประเด็นเดียวก็ตามหากข้อเท็จจริงปรากฏว่าถนนพิพาทเป็นทางสาธารณะ ศาลอุทธรณ์ก็มีอำนาจวินิจฉัยว่าถนนพิพาทเป็นทางสาธารณะได้ หาเป็นการนอกประเด็นไม่ นอกจากอาจารย์โรงเรียนประมาณ 200 คน และนักเรียนประมาณ 3,000 คนแล้ว ยังมีราษฎรซึ่งมีบ้านเรือนอยู่ในละแวกถนนพิพาทกว่า 20 ครัวเรือน ได้ใช้ถนนพิพาทเป็นทางออกสู่ถนนสาธารณะ โดยบางคนใช้ถนนพิพาทมาตั้งแต่เริ่มสร้างเป็นเวลากว่า 10 ปีแล้ว ไม่มีผู้ใดห้ามปราม ถือได้ว่าเจ้าของที่ดินพิพาทเดิมได้ยกที่ดินส่วนที่ถนนพิพาทตัดผ่านให้เป็นทางสาธารณะ อันเป็นการสละที่ดินให้เป็นสาธารณสมบัติของแผ่นดินสำหรับพลเมืองใช้ร่วมกัน ตามประมวลกฎหมายแพ่งและพาณิชย์มาตรา 1304 โดยไม่จำต้องมีการจดทะเบียนยกให้เป็นทางสาธารณะต่อพนักงานเจ้าหน้าที่
