ข้อความในพินัยกรรมที่มีพิมพ์บาง เขียนบ้าง ถือว่าเป็นพินัยกรรมแบบเอกสารเขียนเองทั้งฉบับ เนื่องจากมีความประสงค์ในการจัดการทรัพย์สิน และมีลายมือชื่อผู้ตายลงไว้ในช่องผู้ทำพินัยกรรมและผู้พิมพ์/ผู้เขียน
คำพิพากษาศาลฎีกาที่ 4044/2567
แม้เอกสารหมาย ค.4 จะมีข้อความบางตอนเป็นตัวพิมพ์ โดยตอนบนตรงกลางมีหัวข้อพิมพ์ว่าหนังสือพินัยกรรม จากนั้นมีการพิมพ์ตัวหนังสือแล้วเว้นช่องว่างให้ผู้ทำพินัยกรรมเขียนหรือกรอกข้อความเกี่ยวกับสถานที่ วัน เดือน ปี ที่ทำพินัยกรรม ชื่อ ที่อยู่ของผู้ทำพินัยกรรม และความประสงค์ในการจัดการทรัพย์สิน ซึ่งตามเอกสารปรากฏว่าผู้ตายได้เขียนรายละเอียดดังกล่าวด้วยลายมือ จากนั้นตอนท้ายมีข้อความพิมพ์ด้วยตัวพิมพ์สรุปได้ว่า ผู้ตายได้พิมพ์ข้อความที่เป็นตัวพิมพ์ โดยได้อ่านเข้าใจข้อความที่เป็นตัวพิมพ์ทั้งหมดเห็นว่าถูกต้องตามเจตนาทุกประการโดยไม่มีผู้ใดข่มขู่ จึงได้เขียนข้อความที่เป็นตัวกลางลงในหนังสือพินัยกรรมฉบับนี้ด้วยตนเองขณะที่มีสติสัมปชัญญะสมบูรณ์ทุกประการ ผู้ตายสมัครใจทำหนังสือนี้เองปราศจากบุคคลอื่นใดข่มขู่ หรือทำโดยสำคัญผิด หรือถูกฉ้อฉลแต่อย่างใด โดยได้ทำหนังสือพินัยกรรมนี้ขึ้นไว้ 4 ฉบับ มีข้อความถูกต้องตรงกันและเก็บรักษาไว้ที่ผู้คัดค้าน และมีลายมือชื่อผู้ตายลงไว้ในช่องที่พิมพ์ว่า ผู้ทำพินัยกรรม และผู้พิมพ์/ผู้เขียน เอกสารหมาย ค.4 จึงมีลักษณะเป็นคำสั่งสุดท้ายที่ผู้ตายแสดงเจตนากำหนดการเผื่อตายในเรื่องทรัพย์สินของตนไว้โดยต้องการยกให้แก่บุคคลต่าง ๆ ตามที่ระบุไว้ อันจะเกิดเป็นผลบังคับได้ตามกฎหมายเมื่อตนตายตาม ป.พ.พ. มาตรา 1646 และ 1647 จึงเป็นพินัยกรรมและเข้าลักษณะเป็นพินัยกรรมแบบเอกสารเขียนเองทั้งฉบับตาม ป.พ.พ. มาตรา 1657
ป.พ.พ.มาตรา 1646 บุคคลใดจะแสดงเจตนาโดยพินัยกรรมกำหนดการเผื่อตายในเรื่องทรัพย์สินของตนเอง หรือในการต่าง ๆ อันจะให้เกิดเป็นผลบังคับได้ตามกฎหมายเมื่อตนตายก็ได้
มาตรา 1647 การแสดงเจตนากำหนดการเผื่อตายนั้นย่อมทำได้ด้วยคำสั่งครั้งสุดท้ายกำหนดไว้ในพินัยกรรม
มาตรา ๑๖๕๗ พินัยกรรมนั้น จะทำเป็นเอกสารเขียนเองทั้งฉบับก็ได้ กล่าวคือผู้ทำพินัยกรรมต้องเขียนด้วยมือตนเองซึ่งข้อความทั้งหมด วัน เดือน ปี และลายมือชื่อของตน
การขูดลบ ตก เติม หรือการแก้ไขเปลี่ยนแปลงอย่างอื่นซึ่งพินัยกรรมนั้นย่อมไม่สมบูรณ์ เว้นแต่ผู้ทำพินัยกรรมจะได้ทำด้วยมือตนเอง และลงลายมือชื่อกำกับไว้
บทบัญญัติมาตรา ๙ แห่งประมวลกฎหมายนี้ มิให้ใช้บังคับแก่พินัยกรรมที่ทำขึ้นตามมาตรานี้
