ท้าตำรวจหรือท้าเจ้าหน้าที่ต่อย ไม่มีความผิดฐาน “ดูหมิ่น” ตำรวจหรือเจ้าพนักงานแต่ไม่สมควรกระทำฎีกาที่ 4529/2536และ4327/2540คำพิพากษาศาลฎีกาที่ 4327/2540การกระทำอันเป็นองค์ประกอบสำคัญประการหนึ่งของความผิดตาม ป.อ. มาตรา 136 คือ “ดูหมิ่น” ซึ่งหมายถึงการด่า ดูถูกเหยียดหยาม หรือสบประมาทให้อับอาย ถ้อยคำที่จำเลยกล่าวต่อสิบตำรวจตรี ข.ว่า “แน่จริงมึงถอดเสื้อมาต่อยกับกูเลย” เห็นได้ว่าเป็นการกล่าวท้าทายให้สิบตำรวจตรี ข.ออกมาต่อสู้กับจำเลย อันเป็นเพียงคำกล่าวที่ไม่สุภาพและไม่สมควร ยังไม่ถึงขั้นที่พอจะให้เข้าใจว่าจำเลยมีความมุ่งหมายที่จะด่า ดูถูกเหยียดหยามหรือสบประมาทให้สิบตำรวจตรี ข.อับอาย การกระทำของจำเลยจึงไม่เป็นความผิดตาม ป.อ.มาตรา 136
คำพิพากษาศาลฎีกาที่ 4529/2536หลังจากผู้เสียหายซึ่งเป็นเจ้าพนักงานสรรพสามิตยึดสุราของจำเลยไปแล้ว จำเลยตามไปที่ห้องเปรียบเทียบปรับกรมสรรพสามิต จำเลยพูดกับผู้เสียหายว่าพวกมึงเก่งแต่จับเหล้าไปต่อยกับกูข้างนอกไหมเป็นคำกล่าวที่ไม่สุภาพและไม่สมควรเป็นการพูดเปรยขึ้นมาเพื่อประชดประชันผู้เสียหายโดยเจตนาท้าทายผู้เสียหายให้ออกไปชกต่อยกับจำเลยเท่านั้นหาใช่เป็นการเหยียดหยามดูหมิ่นผู้เสียหายไม่ จึงไม่ผิดฐานดูหมิ่นเจ้าพนักงานซึ่งกระทำการตามหน้าที่
